Judge throws out claims against UA officials

Terry and his attorney have 20 days to re-argue two

Washington County Circuit Judge Mark Linsday dismissed all four claims in a lawsuit alleging the University of Arkansas failed to properly investigate a harshly critical e-mail sent in December to former freshman quarterback Mitch Mustain.

Linsday granted sovereign immunity to UA Chancellor John A. White and UA System President B. Alan Sugg on a claim their actions constituted an illegal exaction of taxpayers funds and on a request for a writ of mandamus forcing further action in the matter.

Linsday gave plaintiff John David Terry and his attorney, Eddie Christian Jr. of Fort Smith, 20 days to re-argue the two remaining claims in the suit: That White’s actions in the matter were a breach of contract and were a breach of fiduciary duty.

The e-mail was sent by Teresa Prewett, a Little Rock woman who is a family friend of UA football Coach Houston Nutt. White had Nutt investigate, and the coach ordered Prewett to write a letter of apology to Mustain and barred her from sidelines at games.
